Section 2

The employer must complete Section 2 within three (3) business days of the employee’s first date of employment.
The employer may have an authorized representative complete the review and verification process on their behalf. For instance, if an employee is working remotely, the employer’s designated agent may complete the form.
The employee’s information from Section 1 is filled in at the top of Section 2.

The employer must then review the employee’s documentation to prove their employment eligibility. The employee must provide either one document from List A, or one document from both List B and List C.

The employer reviews the documents and records the information below in the appropriate section:

After reviewing the employee’s documentation, the employer or authorized representative must sign and date the form to certify that the documents appear to be genuine and demonstrate that the named employee is eligible to work in the United States.

The employer must also fill in the employee’s first date of employment where asked below.

After both Sections 1 and 2 are completed, the employer should keep the signed form on file. Employers are not required to make copies of the employee’s documents, but if an employer decides to keep a copy on file for one employee, they must do so for all employees.
