LCA filed during strike
An employer is not permitted to file an LCA during a strike or lockout that is happening due to a labor dispute in the occupational classification at the place of employment.

LCA filed during strike willfully
A willful violation has a maximum civil money penalty of $5,000 per violation and a minimum debarment of 2 years.
A willful violator that displaces a US worker during a lockout or strike may be subject to an enhanced civil money penalty up to $35,000 and an enhanced department of a minimum of 3 years.
LCA filed during strike non-willfully
A willful violation has a maximum civil money penalty of $1,000 per violation and a minimum debarment of 1 year.
